Terms of Sale (ToS)

1. Preamble
These Terms of Sale (hereinafter “ToS”) govern sales made by DELGINEER (hereinafter “the Seller”), individual company (micro-company), with its registered office located at 7 Rue Pierre Mendès France, 62570, Wizernes, France, registered in the Trade and Companies Register under number 98027743800019, represented by Mr. Geoffroy DELAINE.
DELGINEER offers physical products for sale to private consumers or professionals.
These ToS apply to all sales made through the website https://delgineer.com/, as well as to any order placed by a Customer residing in the European Union or internationally, unless otherwise required by mandatory legal provisions applicable in the consumer's country.
2. Purpose
These ToS define the rights and obligations of the parties in connection with the sale of products by the Seller to individual or professional Customers. They are intended to provide a legal framework for the commercial relationship and to ensure transparency and consumer protection.
3. Scope of application
The ToS apply to all orders placed with DELGINEER, regardless of the buyer's country of residence. All orders imply full and unconditional acceptance of these ToS.
They prevail over any other contradictory document, unless expressly agreed otherwise in writing by the Seller.
4. Products
4.1 Characteristics
The products offered for sale by DELGINEER are designed directly by us. Each item is accompanied by a detailed description enabling the Customer to ascertain its essential characteristics, in accordance with Article L.111-1 of the French Consumer Code.
The photographs, illustrations, or models posted on the website https://delgineer.com/ are provided for informational purposes only and have no contractual value. Slight differences (color, dimensions, finish) may appear between the visuals presented and the final product, without affecting the essential characteristics of the product.
4.2 Availability
Products are offered subject to availability. If a product is unavailable after an order has been placed, DELGINEER will inform the Customer as soon as possible. The Customer may then choose to accept a longer delivery time, request a refund of the amount paid, or cancel the order.
4.3 Compliance
The products manufactured and marketed by DELGINEER comply with current legislation and applicable standards. In the event of a defective or non-compliant product, the Customer benefits from the legal guarantees of compliance and hidden defects, as provided for in Articles L.217-3 et seq. of the Consumer Code and 1641 et seq. of the Civil Code.
5. Prices
5.1 Price display
Product prices are displayed in Australian dollars (AUD), Canadian dollars (CAD), Swiss francs (CHF), Euros (EUR), British pounds (GBP), and US dollars (USD), including all taxes (TTC).
They do not include delivery or processing costs or, for international sales, customs duties and other local taxes, which remain the responsibility of the Customer.
5.2 Price variations
DELGINEER reserves the right to modify its prices at any time. The applicable price is the one displayed at the time the Customer confirms the order.
5.3 Additional costs
- Delivery: delivery costs are calculated and indicated at the time of ordering and are added to the price of the products,
- Customs and international taxes: for orders shipped outside the European Union, customs duties, import taxes, or other local charges may be levied by the competent authorities. These charges are not the responsibility of DELGINEER and are the sole responsibility of the Customer.
6. Ordering
6.1 Creating an account
To place an order, the Customer must first create a personal account on the website https://delgineer.com/, providing accurate and complete information. The Customer undertakes to keep their login details confidential and not to disclose them to third parties. DELGINEER cannot be held liable for any fraudulent use of the account by a third party in the event of negligence on the part of the Customer.
6.2 Ordering process
Once their account has been created, Customers can select the products of their choice and follow the online process:
- Add to basket,
- Check order summary,
- Confirm after accepting these ToS,
- Pay using one of the methods offered.
6.3 Order confirmation
The order is considered firm and final only after payment has been confirmed. All orders imply acceptance of the prices and descriptions of the products on the day of the transaction.
6.4 Order confirmation
After validation, DELGINEER will send the Customer a confirmation email summarizing the essential elements of the order (products, prices, contact details, delivery method). This email serves as acknowledgment of receipt of the order.
6.5 Right of refusal
DELGINEER reserves the right to suspend or refuse any order from a Customer in the event of an existing dispute relating to the payment of a previous order, suspicion of fraud, or non-compliance with these ToS.
6.6 Proof of transaction
The computer records stored in DELGINEER systems, under reasonable security conditions, constitute proof of communications, orders, and payments between the Customer and the Seller.
7. Payment
7.1 Payment terms
The price of the products is payable in full at the time of ordering. No shipment will be made without prior full payment.
7.2 Accepted payment methods
The only accepted payment method is credit card (CB, Visa, Mastercard, American Express, etc.).
7.3 Payment security
Transactions made on the website are secured using an encryption protocol that complies with current standards. DELGINEER does not store the Customer's bank details at any time; these are processed directly by the payment service provider.
7.4 Refusal of payment
In the event of refusal of payment by the Customer's bank, the order will be automatically canceled and the Customer will be informed.
7.5 Retention of title
The products remain the property of DELGINEER until full payment of the price by the Customer. However, the risks of loss, theft, or damage to the products are transferred to the Customer as soon as they are handed over to the carrier.
8. Delivery
8.1 Delivery areas
The products offered by DELGINEER can be delivered within the European Union and internationally, provided that the destination country is served by partner carriers.
8.1.1 Temporary suspension of shipments to the United States
Due to the suspension of postal service to the United States, linked to the implementation of new US customs measures, shipments of goods to that country have been temporarily suspended since August 25. We are monitoring the situation closely and working to resume shipments in strict compliance with the new regulations. We hope to be able to restore service as soon as possible.
8.2 Delivery methods
The Customer can choose between several delivery options offered at the time of ordering (e.g., standard delivery, express delivery). The costs and delivery times associated with each option are specified at the time of order confirmation.
8.3 Delivery times
The delivery times indicated when placing an order are for information purposes only and may vary depending on the destination, the delivery method chosen, and the carrier's constraints.
DELGINEER undertakes to ship the products as soon as possible, but cannot be held responsible for delays attributable to the carrier, force majeure, or customs formalities.
8.4 Delivery costs
Delivery costs are calculated automatically and indicated before the order is finalized. They depend on the country of destination, the weight of the order, and the delivery method chosen by the Customer.
8.5 Transfer of risk
The risk of loss or damage to the products is transferred to the Customer as soon as they are handed over to the carrier. The Customer must check the condition of the package upon receipt. In the event of any anomaly (damaged package, missing product, etc.), it is the Customer's responsibility to immediately express any reservations to the carrier and to inform DELGINEER without delay.
8.6 Delivery address
The Customer is required to provide an accurate and complete delivery address. In the event of an incorrect address or incomplete information attributable to the Customer, any reshipment costs shall be borne by the Customer.
9. Right of withdrawal
9.1 Legal deadline
In accordance with the legal provisions in force (Articles L.221-18 et seq. of the Consumer Code), the Customer has a period of 14 calendar days from receipt of the products to exercise their right of withdrawal, without having to justify their decision or bear any costs other than those related to the return.
9.2 Terms of exercise
To exercise their right of withdrawal, Customers must notify DELGINEER of their decision before the expiry of the aforementioned period, by post or email to the following address: support@delgineer.com.
Customers may use the standard withdrawal form available in the appendix to these ToS, but this is not mandatory.
9.3 Returning products
Products must be returned to DELGINEER in their original condition, complete, unused, and undamaged, within a maximum of 14 days following notification of the decision to withdraw.
- In the event of a simple withdrawal, the direct return costs are the responsibility of the Customer,
- In the event of a defective product or an error in order preparation attributable to DELGINEER, the return costs will be fully covered by the Seller.
9.4 Refund
DELGINEER undertakes to refund the Customer for all sums paid, including the initial delivery costs (excluding additional costs if the Customer has chosen a more expensive delivery method than the standard option offered), within a maximum period of 14 days from receipt of the returned products or proof of their shipment.
The refund will be made using the same payment method used for the order, unless otherwise agreed with the Customer.
9.5 Exceptions
The right of withdrawal does not apply in the cases provided for in Article L.221-28 of the Consumer Code, in particular for:
- Goods made to the Customer's specifications or clearly personalized,
- Goods that deteriorate or expire rapidly,
- Goods unsealed by the Customer that cannot be returned for reasons of hygiene or health protection.
10. Legal warranties and liability
10.1 Legal warranty of conformity
In accordance with Articles L.217-3 et seq. of the French Consumer Code, the Customer benefits from a legal warranty of conformity for any product delivered that does not correspond to the description or that has a functional defect.
The Customer has a period of two years from the delivery of the product to take action. They may choose between repair or replacement of the product, within the limit of the cost being manifestly disproportionate for DELGINEER.
10.2 Warranty against hidden defects
In accordance with Articles 1641 et seq. of the Civil Code, the Customer also benefits from a warranty against hidden defects that would render the product unfit for its intended use, or that would diminish its use to such an extent that the Customer would not have purchased it or would have paid a lower price for it had they been aware of them.
This action must be brought within two years of the discovery of the defect. The Customer may choose between cancellation of the sale or a reduction in the price of the product.
10.3 Warranty exclusions
The warranty does not cover damage resulting from:
- Misuse,
- Lack of maintenance,
- Normal wear and tear,
- Negligence or unauthorized modification of the product by the Customer.
10.4 Liability
DELGINEER cannot be held liable for:
- Delays or inability to deliver due to force majeure or unforeseeable and unavoidable external circumstances (strikes, transport problems, natural disasters, etc.),
- Inconveniences or damage inherent in the use of the Internet (service failure, external intrusion, viruses, etc.).
DELGINEER liability is limited to the amount of the order in question.
11. Intellectual property
11.1 Website content
All elements appearing on the website https://delgineer.com/—including text, descriptions, photographs, illustrations, logos, trademarks, domain names, and the general structure of the website—are the exclusive property of DELGINEER and/or are subject to authorization for use.
11.2 Manufactured products
The products manufactured and marketed by DELGINEER, as well as their designs and specific characteristics, may be protected by intellectual and/or industrial property rights. Any reproduction, imitation, or use without the express authorization of DELGINEER is strictly prohibited.
11.3 Personal use only
The Customer is only authorized to use the products and the website for private and personal purposes. Any reproduction, distribution, communication, modification, or exploitation, even partial, of the protected elements is prohibited without the prior written consent of DELGINEER.
11.4 Penalties
Any unauthorized use of protected content or products constitutes a violation of intellectual property rights and may result in legal action.
12. Applicable law and jurisdiction
12.1 Applicable law
These ToS are governed by French law, subject to the mandatory provisions applicable in the country of residence of the consumer Customer.
12.2 Amicable settlement of disputes
In the event of a dispute, the Customer is invited to contact DELGINEER customer service department in the first instance in order to seek an amicable solution.
The consumer Customer may also have recourse to a consumer mediator free of charge, in accordance with Articles L.612-1 et seq. of the French Consumer Code. The mediator's contact details will be provided by DELGINEER on request.
12.3 Jurisdiction
In the absence of an amicable agreement, any dispute relating to the interpretation, performance, or validity of these ToS shall be brought before the competent French courts.
For professional Customers, exclusive jurisdiction is attributed to the courts within the jurisdiction of DELGINEER registered office.
13. Protection of personal data
13.1 Data collection
When processing orders, DELGINEER collects personal data about the Customer (last name, first name, postal address, email address, telephone number, payment information, etc.).
13.2 Purpose of processing
This data is used solely for:
- Order management and tracking,
- Product delivery,
- Invoicing,
- Communication with the Customer (order confirmation, after-sales service).
13.3 Retention period
Data is retained only for as long as necessary for the purposes mentioned above and in accordance with legal obligations.
13.4 Customer rights
In accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act, the Customer has the right to access, rectify, erase, restrict, object to, and transfer their personal data.
They may exercise these rights by sending a request by email to: webmaster@delgineer.com or by post to the address of DELGINEER registered office.
13.5 Data sharing
Personal data is only shared with partners necessary for processing and fulfilling the order (e.g., payment providers, carriers). DELGINEER undertakes not to sell or transfer data to third parties without the Customer's prior consent.
13.6 Security
DELGINEER implements all necessary technical and organizational measures to ensure the security and confidentiality of the personal data collected.
